For immediate release: Potential Civil Liability Under State and Federal Law Arising Out of Enforcement of Executive Orders that Call for Suppressing Constitutional Rights

The following Memorandum of Law discusses generally the potential civil liabilities faced by the Barry County Sheriffs Office (BCSO) and the personnel that work for said office in the enforcement of executive orders suppressing certain freedoms arising out of the state and federal government’s COVID-19 pandemic response.
The memorandum is developed in general terms as it is meant to convey the reality that all governmental entities and employees of Barry County that seek to enforce these current executive orders are at risk of incurring enormous civil liability.
